Understanding the Arraignment Process
Do you have an arraignment for a criminal charge pending and are unsure of what that’s going to actually look like? Hi, I’m Tahlequah criminal attorney Aaron Grubb at Wirth Law Office. In this video, we’re just going to talk about what an arraignment is and what it looks like.
So first off, what happens before an arraignment is you get arrested and you’re charged with some sort of crime. They will give you a court date and tell you to show up with or without an attorney. If you show up with an attorney, the judge is going to read off the information or ask if you want the information to be waived.
What Happens During an Arraignment
Waiving the reading of the information means you don’t have to state your name, address, or the circumstances surrounding your charges. During the arraignment, your attorney will typically do four things: waive the reading of the information, enter a plea—usually not guilty, file their entry of appearance, and submit a motion for discovery.
This process sets you up for the next stage, which involves discussing your case with the District Attorney and possibly negotiating a deal before a trial is scheduled. It’s important to remember that throughout this process, you can maintain communication with your attorney to find a deal that works for you.
The Importance of Having Legal Representation
The arraignment is very important because it sets the tone for the rest of the litigation. Having an attorney shows that you’re willing to take responsibility and invest in professional representation to ensure you get the best outcome for your case. This demonstrates a proactive approach to dealing with your charges.
