Essential Tips for Documenting Abuse Evidence
Are you in an abusive or unstable situation, and do you want to make sure that anything that you document is actually seen at court? Hi, my name is Aaron Grubb, I’m the Tahlequah criminal attorney at Wirth Law Office.
In this video, we’re talking about how to preserve evidence if you’re in an abusive relationship or an uncomfortable situation. These tips can make a real difference, whether you’re protecting yourself now or preparing for a future legal case.
Tip 1: Save Your Text Messages
Make sure your text messages aren’t being deleted or altered. Some platforms — like iMessage — can allow messages to disappear, and apps like Snapchat automatically delete chats. Avoid using apps that don’t keep a permanent record of conversations. Stick to standard messaging apps when possible.
Tip 2: Record or Document Conversations
If you’re able to record phone calls legally (check your state laws), do so. If that feels too technical, simply keep a journal. Write down what happens each day: what was said, what occurred, and how you felt. Dates and details matter.
Tip 3: Tell Someone You Trust
Let trusted friends or family members know what’s happening. Ask them to keep records of what you share. The more people who can back up your experience, the stronger your position may be later.
Tip 4: File a Police Report
This is one of the most important things you can do. If you feel unsafe or there has been physical abuse, file a police report — even if you’re hesitant. You might not want to take that step, especially if the other person is a family member or someone close to you. But police reports create a legal record that could be critical if you pursue a protective order, custody case, or paternity case later on.
Your safety is the top priority — and preserving evidence helps you protect yourself and your future.
