The Steps in an Adult Guardianship Case
First, a petition must be filed stating that the ward—or the person in question—is incapacitated and requesting a guardianship be established over them. Second, the ward and any close relatives must be served and given notice of the proposed guardianship. This ensures all parties are informed and can participate in the process.
Third, the court will set a hearing to discuss the situation. Important issues such as the level of incapacitation and the support needed by the ward will be examined. Additionally, the court will conduct a background check on the proposed guardian to ensure they are fit for the responsibility.
Finalizing the Guardianship Process
Step four involves the court officially appointing a guardian. This decision is made based on the information and evidence presented during the hearing. Finally, step five requires the guardian or ward to provide annual reports to the court detailing how the ward is doing and the status of the guardianship itself.
