First of all, legal custody is where one of the parents gets to make significant decisions for the child. This includes decisions such as educational choices, religious affiliations, and disciplinary measures. Physical custody refers to where the child lives and is cared for.
Types of Legal Custody
There are two types of legal custody: joint custody and sole legal custody. Joint custody allows both parents to come together and make decisions for the child. In this arrangement, one parent may specialize in certain areas like education, while the other takes on more responsibilities related to discipline.
Sole legal custody, on the other hand, means one parent makes all the significant decisions for the child. Although the other parent can usually have a voice in emergencies or smaller matters, the primary custodian generally has the final say in important decisions.
Understanding Physical Custody
Now, let’s discuss physical custody, which focuses on where the child physically resides. Physical custody can take many forms and may be arranged according to state guidelines, or a custom schedule can be agreed upon by the parties involved.
One unique arrangement is called bird nesting. In this setup, the children remain in the primary residence while the parents alternate living there, each spending time in the home where the children are. While I haven’t encountered this often in my legal practice, it is an option available in Oklahoma.
Exploring Additional Custody Types
Another form of physical custody is known as split custody. This can occur when parents share multiple children and decide that each parent will take primary responsibility for one child, while having visitation rights for the others. This arrangement can be quite flexible and tailored to fit the family’s needs.
