Understanding Your Affidavit of Service
Did you just receive some legal looking documents and are not really sure what’s going on? Are you confronted by a lawyer trying to make you sign something called an affidavit of service? I’m Tahlequah criminal attorney Aaron Grubb with Wirth Law Office. In this video, we’re going to discuss what service means and why it’s important.
Service is the legal process that ensures all required parties to a lawsuit are informed of what’s happening. If you’re suing someone, it’s crucial that they know they are being sued. Without this notification, you can’t expect them to make concessions or pay restitution, which are essential to resolving your case.
What is an Affidavit of Service?
An affidavit of service is a document that verifies the other party has received and understood the legal paperwork you are filing. This document confirms that the necessary parties are now aware of the legal proceedings against them. This ensures transparency and upholds the integrity of the legal process.
Additionally, there is a subset of this known as a waiver of service. This occurs when two amicable parties can skip the formality of having a process server deliver paperwork every time something gets filed. Instead, the parties will sign a waiver, which allows for more informal communication regarding the legal documents being served.
