In this video, we’re going to explain what a conflict of interest is and why it matters in your legal case. If you believe the opposing attorney may have a conflict — maybe they represented you in the past, or someone close to you — it’s important to tell your attorney right away.
Identifying Potential Conflicts
Your attorney will evaluate whether the other side has an unfair advantage because of that prior relationship. For example, if the opposing attorney previously represented you, they may know sensitive information like:

- Details about your personal life

- What tends to upset you or influence your decisions
Even if they didn’t represent you directly, the same concern can apply if they represented a close family member or interacted with you as a witness in another case. The key question is: Does the attorney have personal, inside knowledge that could now be used against you? If so, that could be a true conflict of interest.
What to Do If You Suspect a Conflict
If your attorney believes this is the case, they can raise the issue before the judge to ensure your case is handled fairly. If you ever feel unsure, it’s always better to speak up early — your legal team can take it from there.
