Understanding Legal Separation: Key Differences Explained
Do you know what legal separation is? Hi, I’m Tahlequah family attorney Aaron Grubb at Wirth Law Office, and in this video, we’re just going to talk about what legal separation is.
Legal separation is similar to divorce in many ways, but there’s a key difference. Divorce has two stages: first, the temporary order stage, where the court sets arrangements for child custody, asset division, and other matters during the divorce process.
The second stage is the final divorce decree, which legally ends the marriage and allows both parties to remarry. A legal separation, on the other hand, is essentially just the temporary order stage without finalizing the divorce.
The Purpose and Process of Legal Separation
It establishes court-ordered terms for custody, finances, and asset division, providing legal protections while the marriage remains intact. However, legal separation does not dissolve the marriage, meaning you cannot legally remarry.
